Important notice

It first must be noted that foreign architects who accept an assignment on the Belgian territory are subject to the same laws and professional rules as Belgian architects.




Nationals of countries in the European Union or another Member State of the European Economic Area (Liechtenstein, Iceland and Norway).

Required form(s)

  • the form of prior declaration (click here to download this form);
  • the form "Declaration regarding the architect's assignment" (click here to download this form);
  • where appropriate, for each building permit request, in order to obtain the necessary certificate, a "Declaration form regarding the architect's assignment"

Required documents:
1° a certificate demonstrating that the person in question legally performs the activities concerned in the Member State where he is established;
2° a certificate that demonstrates that the person concerned holds one of the diplomas, certificates or other titles, included in the annex to the Law of 20 February 1939 on the protection of the title and the profession of architect;
3° [if neither the profession nor the education providing access to the profession is regulated in the member state of establishment, a certificate that demonstrates that the service provider has exercised the profession of architect for at least two years in the ten years preceding the service provision] ;
4°an insurance certificate regarding professional liability, including ten-year liability. The certificate can be issued by an insurance company of another Member State if it indicates that the insurer complies with the legal and administrative rules applicable in Belgium regarding the nature and extent of the cover. These rules are included in article 9 of the Law of 20 February 1939, and in the Royal Decree of 25 April 2007.
5°a proof of nationality of the service provider.

Permanent establishment in Belgium
Legal base:
- Law of 20 February 1939 on the protection of the title and profession of architect, art. 1;
- Law of 20 February 1939 on the protection of the title and profession of architect, annex;
- Directive of the Council of the European Communities of 10 June 1985 (85/384/EEG), art. 17-21;
- Law of 26 June 1963 for implementation of an Order of Architects, art. 8 Procedure;
- To register with the Provincial Council of the Order of Architects competent for the chosen location for the exercise of the profession (Note: in the Brussels Capital Region the Council of Brabant with Dutch as working language and the Council of Brabant with French as working language are competent depending on the chosen language.).

One-off assignments, also called services provided
Legal base:
- Directive of the Council of the European Community of 10 June 1985 (85/384/EEG), art. 22;
- Law of 26 June 1963 for the implementation of an Order of Architects, art. 8 Procedure;
- Register with the National Council of the Order to be included in the register of service providers ;
- Submit the required documents mentioned in the European Directive.





Nationals of other countries who are not holding a legal Belgian diploma that provides access to the profession of architect


Permanent establishment or temporary exercise of the profession in Belgium
Legal base:
- Law of 20 February 1939 on the protection of the title and profession of architect, art. 8;
- Law of 26 June 1963 for the implementation of an Order of Architects, art. 8.
Procedure
- Depending on the chosen language, submit a request to the Flemish or French community to obtain a Ministerial Decree that establishes the equivalence of the degree with the Belgian legal architect diploma
- Submit a request to the services of the FPS Science policy to obtain a Royal Decree for admission to the exercise of the profession of architect in Belgium (more info: http://www.belspo.be/belspo/cultedu/edu_access_en.stm).
- As soon as you are in the possession ofboth Decrees, register with the Provincial Order of Architects, competent for the selected location for the exercise of the profession (Note: in the Brussels Capital Region the Council of Brabant with Dutch as working language and the Council of Brabant with French as working language are competent depending on the chosen language.)
